The Agriculture and Rural Affairs Bureau of Jinzhou City, Hebei Province recently cracked down on a case involving the online sale of counterfeit pesticides.
Jinzhou City Agricultural Supplies Store was found selling "Tripterygium Potassium Rodenticide" on the Pinduoduo platform, labeled with:
·Pesticide Registration No.: P30090035600
·Production License No.: Pesticide-Production Permit (Su)0309
·Manufacturer: Xuzhou Lida Industrial Co., Ltd., Jiangsu
Investigation Findings:
·Both the pesticide registration number and production license were forged
·The product was produced without legal pesticide registration
·Classified as counterfeit pesticide per regulations
Investigation revealed that the agricultural supplies store purchased a total of 80 bags (240g/bag) of the implicated pesticide at 7 RMB/bag, of which:
·78 bags were sold
·2 bags were self-used
·Total illegal proceeds: 792.71 RMB
Pursuant to Article 55(1)(2) of the Pesticide Management Regulations and in reference to the Hebei Province Agricultural Administrative Penalty Discretion Benchmark (pesticide section), the Jinzhou Agriculture and Rural Affairs Bureau has lawfully imposed an administrative penalty decision of "confiscation of illegal gains amounting to 792.71 yuan and a fine of 5,500 yuan" on the implicated agricultural supplies store. The penalty strictly adheres to statutory standards, with the fine set at 6.94 times the illegal proceeds, reflecting the severity of violations including online sales of counterfeit pesticides and forgery of regulatory documents (Registration No. P30090035600), while demonstrating rigorous enforcement of both the Pesticide Management Regulations and E-Commerce Law vendor verification obligations.
